Three Texas companies recently recalled 320,000 pounds of meat sold recently because of misbranding and undeclared peanut allergens in seasonings. The companies are H-E-B and Garcia Foods, both from San Antonio, and J & B Sausage Company, from Dallas.
H-E-B recalled 83,000 pounds of pork products, including chorizo. Garcia recalled mostly raw pork sausage links. J & B Sausage Company recalled taco filling, beef chili, ground beef with potatoes, and seasoned beef in gravy. The meats were removed from retail stores throughout Texas and from one school district.
The huge recall was due to the threat of allergic reactions caused by peanuts. Some people can have deadly reactions if they consume peanuts. Fortunately, there have been no reports of any adverse reactions. Anyone with one of the meat products is urged to contact the company in order to receive a refund.
Accidents in the processing of food can happen. Although it’s unclear what happened here, obviously at some point in the process, the meats involved were contaminated with peanut allergens. In some cases, companies will choose to pretend as if they aren’t aware of the problems, and hope that no one becomes ill as a result of the products. If someone does become ill, the company will often pretend that it wasn’t aware there was a problem, and may later issue a recall. The companies involved in this situation were proactive and recalled the food before someone became ill.
If a company manufactures unsafe food and a consumer is harmed, the company can be held legally liable for damages. In some cases, the damages may be low – maybe minor medical expenses. In other situations, the tainted food can cause death or serious injury.
